SPONSOR: Trudell Medical International Inc. doing business as Trudell Medical International , 725 Baransway Drive, London Ontario, N5V 5G4, Canada is the sponsor of this Promotion (“Trudell” “we,” “our” or “us”).
PROMOTION TERM: .
There will be four (4) quarterly entry periods during the 2025 calendar year from January 1 to March 31; April 1 to June 30; July 1 to September 30; and October 1 to December 31 (each, an “Entry Period”). Entries must be received by 11:50 p.m. Eastern Time Zone on the last day of the applicable quarterly Entry Period. For example, for the first quarterly Entry Period, entries will be accepted until 11:59pm Eastern Time Zone on March 31. Trudell’s computer system is used to govern all computer and time-related aspects of the Promotion and is the official time keeping device for this Promotion.
ELIGIBILITY: To be eligible for entry:
you must complete the promotion requirements in full in accordance with the ‘How to Enter’ section below;
you must be a legal resident of your country of residence, and 18 years of age or older at the time of entry;
you or any of your immediate family members (defined as spouse, dependent for federal income tax purposes, or step or biological mother, father, sister, brother, daughter or son) cannot be an employee, director or officer of Trudell or of any affiliate of Trudell;
You will be disqualified if you fail to meet any one or more, or part, of any of the above eligibility criteria.
HOW TO ENTER: NO PURCHASE OR FEE TO ENTER THIS PROMOTION IS NECESSARY TO PARTICIPATE OR WIN. Internet access and/or cellular data is required to participate.
To enter, you must sign up to be a subscriber of the myAero Community program by visiting https://www.trudellmed.com/global/en/join-myaero-community (the “Promotion Site”) and complete the registration form provided by Trudell. Each person that completes and successfully submits the registration form is referred to in these Rules as a “Participant” or “you”.
PRIZE: The prize comprises: of one (1) Garmin smart watch, one (1) toque, one (1) AeroBear, and one (1) water bottle with an approximate retail value of $300 CAD* (collectively, the “Prize”). A total of one (1) Prize will be available to be won in each quarterly Entry Period. The Prize will be awarded by Trudell to the selected winning Participant, for a total of one (1) winning Participant for each quarterly Entry Period. The Prize elements and value may vary and are subject to availability and change from time to time at Trudell’s sole discretion. We may in our sole discretion, substitute any portion of any Prize for something of equal or greater value. No Prize changes, transfer, assignment or substitution by the winning Participant is permitted. All taxes or other similar charges on the Prize are the sole responsibility of the winning Participant.
LIMIT: 1 PRIZE PER PARTICIPANT PER APPLICABLE ENTRY PERIOD. You may use only one email address to enter. Trudell shall have the right at any time to require proof of identity and/or eligibility to participate in the Promotion and compliance with these Rules. Failure to provide such proof may result in disqualification. If a dispute arises regarding the identity of a Participant, the proper Participant will be the authorized account holder of the e-mail address used to enter the Promotion. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. We are not responsible for late, erroneous, misdirected or incomplete entries, or for any computer-related, online, telephonic, or technical malfunctions that may occur. Entries will be considered void if they are in whole or in part illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error, forged, mechanically reproduced or obtained through fraud or theft, or if they do not comply with these Rules.
SELECTION OF WINNER: Potential winning Participants will be randomly drawn from all eligible entries received during the applicable Entry Period. The selection will be held at Trudell’s Head Office, 725 Baransway Dr, London, Ontario, Canada, within one month from the last day of the applicable Entry Period. To win, the potential winning Participants must correctly answer, without assistance of any kind, whether mechanical, electronic or otherwise, a time-limited mathematical skill testing question. The potential winning Participants will be notified by Trudell via the email address provided with their entry within approximately 15 days following selection. The potential winning Participants may be required by Trudell to execute and return, within 2 weeks of issuance of Trudell’s notification to potential winning Participants that they have been selected, an affidavit of eligibility, an assignment of rights, a release of liability, and (where legal) an intellectual property and publicity rights release (“Prize Documents”), which may include, without limitation, a release of the Released Parties as set forth below. If a potential winning Participant cannot be contacted, or fails to sign and return the Prize Documents within the specified time period, or is found to be ineligible, or fails to correctly answer the time-limited mathematical skill testing question, or otherwise does not meet all Rules, that potential winning Participant will be deemed disqualified and will forfeit the Prize. In the event that a potential winning Participant is disqualified for any reason, we may redraw from eligible Entries received during the applicable Entry Period. Winning Participants will have their respective Prize delivered to them at the shipping address provided on the winner declaration form.
ODDS OF BEING SELECTED: The odds of winning a Prize depends on the number of eligible Entries received during each applicable Entry Period.
GENERAL CONDITIONS: Each winning Participant will be instructed by Trudell on how to claim his or her Prize. Each winning Participant may be required to produce a valid driver’s license or valid picture I.D. (in addition to any other proof of identity documents Trudell may request) to accept delivery of his or her Prize. Trudell is not responsible for lost, stolen, late or misdirected email or delivery or communication problems of any kind. All decisions made by Trudell with respect to all aspects of this Promotion are final. Trudell reserves the right to disqualify a person if he/she enters this Promotion or tries to do so by any means contrary to these Rules or applicable laws, [MC1] [SG2] [MC3] or where entries are generated, by any mechanical or automated means or manipulated with a view to circumvent the Rules or applicable laws or otherwise cause unfair advantage. Any attempt to deliberately damage or impair the Promotion Site or to undermine the legitimate operation of the Promotion is a violation of laws and may be subject to remedies and damages, including criminal prosecution. This Promotion is subject to applicable laws and is void where prohibited. All entries become the property of Trudell and will not be verified or returned. This Promotion is in no way sponsored, endorsed, administered by, or associated with any of the companies that the Prize originates from.
PUBLICITY: By entering the Promotion, each Participant agrees to be bound by these Rules and the decisions of Trudell with respect to all aspects of this Promotion, and consents to the use of their name, residence, likeness, photograph, image and voice without payment or compensation, in any publicity or advertising in any medium carried out by Trudell.
CONSENT TO USE AND DISCLOSE PERSONAL INFORMATION: By entering the Promotion and voluntarily providing personal information including, but not limited to name, address, city, province, country, home phone number, e-mail address, and social media username (“Participant Information”), you consent to Trudell collecting and using your Participant Information for the purpose of administering the Promotion and for selecting the winning Participant, and for any other purpose as identified in these Rules or in Trudell’s Privacy Policy subject to applicable data protection laws. Participant Information received for this draw will not be sold or rented to a third party for any purpose whatsoever.
MODIFICATION OR TERMINATION: Subject to applicable law, Trudell may, in its sole discretion, cancel, terminate, modify the Rules and/or administration of or suspend this Promotion in whole or in part without prior notice with no obligation or liability, including if, for any reason the Promotion is not capable of running as planned, whether due to technical failure, or computer virus, tampering, fraud, or corruption of security or proper administration of the Promotion or other causes beyond the control of Trudell. In such event, a winner may be selected by randomly drawing from among all valid entries received up to the time of cancellation, termination, or suspension.
LIABILITY AND RELEASE: Trudell, its affiliates, and each of their respective directors, officers, partners, agents and employees (“Released Parties”) shall not be responsible for any injuries, loss or damages of any kind (compensatory, direct, incidental, consequential or otherwise) with respect to or in any way arising from, this Promotion or the Prize awarded, including but not limited to: (i) lost, stolen, not received, destroyed, damaged, misdirected, illegible, incomplete, fraudulent or late entries which will be void and not eligible; (ii) failure to receive entries for any reason or technical failure or errors of any kind, including but not limited to incorrect or inaccurate capture or loss of entry information, omissions, lost/delayed/garbled data, transmission failure, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, servers, or software, traffic congestion on the internet or any website or any other online communication problems or any combination thereof; (iii) seeding or printing or typographical errors in any Promotion related material or error; or (iv) any injury or damage to Participants’ or any other persons’ computer system(s) due to viruses or otherwise breaches of privacy due to interference by third party computers. A winning Participant’s refusal or inability to accept a Prize awarded shall release Trudell from all obligation. In no event shall Trudell be held to award more than one (1) Prize to one (1) person or to award the Prize otherwise than in compliance with these Rules. By participating in the Promotion, you agree to release the Released Parties harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Promotion or resulting from acceptance, possession or use of any Prize including without limitation any claims based on publicity rights, defamation or invasion of privacy.
GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations as between you and Trudell in connection with the Promotion shall be governed by and construed in accordance with the domestic laws of the country in which this Promotion takes place where the winning Participant is selected in accordance with the Rules, including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
